Welcome to FitSportsy, operated by Geeks Life Technology Solutions PVT LTD. By accessing or using FitSportsy (the “Platform”), you agree to comply with and be bound by these Terms and Conditions of Use (the “Terms”). If you do not agree to these Terms, you should not use the Platform.

1. Platform Overview

FitSportsy is a fitness and sports coaching discovery platform that connects users with coaches, academies, venues, and event organizers. We help users explore, book, and participate in various sports and fitness activities. All services, including coaching sessions, tournaments, and court bookings, are provided by independent third-party organizers.

2. Eligibility

To use FitSportsy, you must:

Be at least 18 years old or have the consent of a parent or guardian if under 18.

Agree to use the Platform in compliance with these Terms and all applicable laws.

3. Account Registration and Security

Account Creation: Certain features of the Platform require you to create an account with accurate and complete information.

Account Security: You are solely responsible for safeguarding your account credentials. Any activity under your account is deemed your responsibility.

Account Termination: FitSportsy reserves the right to suspend or terminate accounts found to be violating these Terms or involved in unlawful activities.

4. Use of the Platform

You agree to use FitSportsy solely for lawful purposes and as intended under these Terms. Prohibited actions include, but are not limited to:

Misuse, disruption, or abuse of the Platform or its users.

Copying, distributing, or modifying Platform content without written permission.

Engaging in fraudulent activities or attempting to breach the Platform's security.

5. Bookings, Payments, and Fees

Direct Payments to Organizers: All payments for coaching sessions, tournaments, and other activities are made directly to the respective organizers using their UPI QR codes.

FitSportsy’s Role: FitSportsy acts solely as a discovery, booking facilitation, and support platform. We do not process or handle any payments.

Payment Disputes: Any disputes related to payments, refunds, or cancellations must be resolved directly with the organizer.

6. Cancellations, Refunds, and Event Changes

Organizer-Driven Policies: Each organizer sets their own cancellation, refund, and rescheduling policies. FitSportsy is not responsible for enforcing or processing refunds.

Event Changes: Organizers may modify or cancel events, coaching sessions, or schedules. FitSportsy will assist in communication and support but holds no liability for such changes.

7. Liability and Disclaimer

Independent Service Providers: All coaching, events, and activities are conducted by third-party organizers. FitSportsy does not guarantee the quality, safety, or outcome of any service.

Limitation of Liability: To the fullest extent permitted by law, FitSportsy and Geeks Life Technology Solutions PVT LTD are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or participation in any activity.

Indemnification: You agree to indemnify and hold FitSportsy harmless from any claims, damages, or liabilities arising out of your actions or participation in any event or session.

8. Intellectual Property

All content on the Platform, including logos, graphics, text, and software, is the intellectual property of FitSportsy or its licensors. Unauthorized use is strictly prohibited.

9. Privacy

10. Modifications to the Terms

FitSportsy reserves the right to update these Terms at any time. Continued use of the Platform after such updates constitutes your acceptance of the revised Terms. Users are encouraged to review these Terms periodically.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Bangalore, Karnataka, India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore.
